Terms of Service

These terms govern your access to and use of the RoxVerify platform, API, and associated services. Please read them carefully before using our services.

ℹ️
By accessing or using RoxVerify services, you agree to be bound by these Terms. If you do not agree, do not use our services. Enterprise customers are governed by a separately executed Master Service Agreement (MSA) which takes precedence over these Terms.

1. Services

RoxVerify provides identity verification, AML screening, biometric liveness detection, fraud prevention, and related services via API ("Services"). Access is granted to registered business customers ("Customers") subject to completion of identity verification of the Customer entity and its authorised users.

2. Permitted use

Customers may use the Services solely for lawful identity verification purposes within their own products and services. Prohibited uses include:

Verifying identities for unlicensed financial activities
Reselling API access to third parties without a written reseller agreement
Using verification outputs to discriminate unlawfully
Attempting to reverse-engineer, bypass, or stress-test the platform
Processing data of individuals in jurisdictions where RoxVerify is not licensed to operate

3. Customer obligations

Customers are responsible for: (a) obtaining all necessary consents from end-users before initiating verification; (b) maintaining a valid legal basis for processing biometric and identity data; (c) complying with all applicable AML, data protection, and consumer protection laws in jurisdictions where they operate; and (d) keeping API credentials secure and rotating them immediately if compromised.

4. Service levels

RoxVerify targets 99.99% API availability. Scheduled maintenance windows are communicated at least 48 hours in advance. Enterprise customers receive SLA commitments via their MSA including financial remedies for downtime exceeding agreed thresholds.

5. Intellectual property

All intellectual property in the RoxVerify platform, documentation, models, and APIs remains the property of RoxVerify. Customers are granted a limited, non-exclusive, non-transferable licence to use the Services for the duration of their subscription. Verification output data generated from a Customer's end-users belongs to the Customer.

6. Limitation of liability

To the maximum extent permitted by law, RoxVerify's total liability for any claim arising from these Terms or the Services is limited to the fees paid by the Customer in the three months preceding the event giving rise to the claim. RoxVerify is not liable for indirect, incidental, consequential, or punitive damages.

7. Termination

Either party may terminate Services on 30 days' written notice. RoxVerify may suspend or terminate access immediately for material breach, non-payment, or if continued access poses a legal or security risk. Upon termination, Customer data is retained for 30 days then deleted, except where regulatory retention obligations apply.

8. Governing law

These Terms are governed by the laws of England and Wales. Disputes shall be resolved by the courts of England and Wales, unless the Customer's MSA specifies an alternative jurisdiction. Customers in the EU may also benefit from applicable consumer and data protection laws in their member state.
